I. General Terms and Conditions

 

§ 1 Basic provisions

 

(1) The following terms and conditions apply to contracts that you conclude with us as a provider (GREENJET GmbH) via the website www.greenjet.at or close associated online presences. Unless otherwise agreed, the inclusion of any terms and conditions you may have used is objected to.


(2) A consumer within the meaning of the following regulations is any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to either their commercial or independent professional activity.

An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

 


 

§ 2 Conclusion of the contract

 

(1) The subject of the contract is the sale of goods.


(2) When you place the respective product on our website, we make you a binding offer to conclude a contract via the online shopping cart system under the conditions stated in the item description.


(3) The contract is concluded via the online shopping cart system as follows:

The goods intended for purchase are placed in the “shopping cart”. You can use the corresponding button in the navigation bar to access the “shopping cart” and make changes there at any time.

After clicking on the “Checkout” button and entering your personal data as well as the payment and shipping conditions, the order details will be displayed to you as an order overview.

Before submitting the order, you have the option to check all information, change it or cancel the ordering process.

By sending the order using the “order with payment” button, you declare your legally binding acceptance of the offer, which means the contract is concluded.


(4) Your requests to create an offer are non-binding for you. We will make you a binding offer in text form (e.g. by email), which you can accept within 5 days.


(5) The processing of the order and the transmission of all information required in connection with the conclusion of the contract is carried out by email - partly automated. You must ensure that the email address you provide is correct and that emails can be received.

 


 

§ 3 Special agreements on payment methods offered

 

(1) Payment via Klarna

In collaboration with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options: invoice (“Pay Later”), installment purchase (“Financing”), direct debit, credit card and instant transfer.

(2) Payment via PayPal / PayPal Checkout

§ 4 Right of retention, retention of title

 

(1) You can only exercise a right of retention for claims arising from the same contractual relationship.

(2) The goods remain our property until the purchase price has been paid in full.

(3) If you are an entrepreneur, the following also applies:

a) Ownership of the goods remains reserved until all claims have been settled.

b) Pledging or transfer of security is not permitted before the transfer of ownership.

c) If you resell the goods, you assign all resulting claims to us.

 


 

§ 5 Warranty

 

(1) The statutory liability rights for defects apply.

(2) Consumers are asked to check the goods for completeness and visible defects upon delivery and to inform us of any complaints.

(3) For entrepreneurs, a warranty period of one year applies from delivery of the goods - claims for damages arising from physical injury or damage to health as well as damage caused by gross negligence are excluded.

 


 

§ 6 Choice of law

 

(1) Austrian law applies. For consumers, this only applies to the extent that the protection granted by mandatory provisions of the country of residence is not withdrawn.

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

    The technical steps for concluding the contract, the contract conclusion itself and the correction options result from Section 2 of these General Terms and Conditions.

  2. Contract language and storage

    The contract language is German.

    We do not save the complete contract text. Before sending your order, you can print out your data or save it electronically. After the contract has been concluded, you will receive all relevant information by email.

  3. Essential characteristics of the product or service

    These can be found in the respective product description.

  4. Prices and payment methods

    All prices quoted include statutory VAT. Shipping costs are shown separately. Payment methods can be selected during the ordering process.

  5. Delivery conditions

    Delivery dates and possible restrictions can be found in the respective offer.

    For consumers, the risk of accidental loss only passes to the buyer when the goods are handed over.

  6. Statutory liability law for defects

    Liability for defects is governed by Section 5 of these General Terms and Conditions.
